1. Acceptance of Terms
By accessing and using DomainSurfer ("the Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
We reserve the right to update and change these Terms at any time. Your continued use of the Service following any changes constitutes acceptance of those changes.
2. Description of Service
DomainSurfer provides a domain search and research platform that allows users to:
- Search across a database of 230+ million domains
- Perform bulk domain searches and DNS lookups
- Monitor DNS records for changes
- Track SERP rankings and domain appearances
- Access domain research tools and features
3. Account Registration
To access certain features of the Service, you must register for an account. When you register, you agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate and current
- Maintain the security of your password
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for all activities that occur under your account.
4. Acceptable Use Policy
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights of others
- Transmit malware, viruses, or other harmful code
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Service or servers
- Use automated systems (bots, scrapers) without explicit permission

- Use the Service for domain squatting or cybersquatting

Violation of this policy may result in immediate termination of your account.
5. Subscription Plans and Billing

We offer various subscription plans with different features and usage limits. Current pricing and plan details are available on our Pricing page. We reserve the right to modify our plans and pricing at any time.
5.2 Billing
Subscription fees are billed in advance on a monthly or annual basis. By subscribing, you authorize us to charge your payment method for the applicable fees. All fees are non-refundable except as required by law or as explicitly stated in these Terms.
5.3 Cancellation
You may cancel your subscription at any time. Cancellation will be effective at the end of your current billing period. No refunds will be provided for partial subscription periods.
5.4 Usage Limits
Each plan includes specific usage limits (searches, domains, monitoring slots). If you exceed your plan limits, you may be required to upgrade or your access may be restricted.
6. Intellectual Property
6.1 Our Content
The Service and its original content, features, and functionality are owned by DomainSurfer and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
6.2 Domain Data
The domain data we provide is aggregated from publicly available sources. We make no claim of ownership to the underlying domain names or DNS records. You may use this data for your own research and business purposes but may not resell or redistribute it.
6.3 User Content
You retain ownership of any search queries, domain lists, or other content you create using the Service. By using the Service, you grant us a license to use this content solely to provide and improve the Service.
7. Data Accuracy and Availability
While we strive to provide accurate and up-to-date information, we do not guarantee the accuracy, completeness, or reliability of any data provided through the Service. Domain data may be outdated or incorrect. You should verify any critical information independently.
We do not guarantee uninterrupted or error-free operation of the Service. We may suspend or terminate the Service for maintenance, updates, or other reasons at any time.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOMAINSURFER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
11. Indemnification
You agree to indemnify and hold harmless DomainSurfer and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another party.
12. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including but not limited to breach of these Terms.
Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
14. Dispute Resolution
Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court to prevent infringement of intellectual property rights.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and DomainSurfer regarding the Service and supersede all prior agreements and understandings.
